1. Agreement
In short: by using Jarvis or this website, you agree to these terms.
These terms are an agreement between you and Usejarvis Inc., a Delaware corporation ("we", "us"). They apply to the Jarvis software, the hosted Jarvis service, and this website (together, the "Service"). By downloading, installing or using any part of the Service, you agree to these terms. If you do not agree, do not use the Service.
Our privacy policy explains what data we handle and who else processes it. Our disclaimer explains what Jarvis can do on your machine and in your accounts. Both form part of these terms.
2. Eligibility
In short: you must be an adult, and if you act for a company you must be allowed to.
You must be at least 18 years old and able to enter into a binding contract where you live. If you use the Service on behalf of a company or other organisation, you confirm that you have authority to bind it to these terms, and "you" includes that organisation.
3. Two ways to run Jarvis
In short: self-hosted runs on your hardware for free; hosted runs on ours for a subscription.
Jarvis can be run in two ways, and several sections below depend on which you use.
- Self-hosted. You run the Jarvis brain on hardware you control, using your own AI provider keys. No account, subscription or server of ours is involved.
- Hosted. We run the brain for you on our infrastructure and include AI usage. This is what a paid plan provides. The app on your own computers runs the same way in both cases.
4. Self-hosted Jarvis is free
In short: self-hosting is free, permanently, and this section survives future changes to these terms.
Self-hosted Jarvis is free of charge, and will remain so. We will not place the self-hosted software behind a fee, licence key, seat limit, activation server, usage meter or time limit.
This commitment is given effect by the software licence. Each release is published under the Jarvis Source Available License, which grants a royalty-free right to use, copy, modify and distribute that release. The licence that accompanies a release governs that release and cannot be revoked for copies you already have.
Self-hosted Jarvis is provided without support, service levels or response times. Support is available through the community and the issue tracker. Costs charged by AI providers you configure are yours.
5. The software licence
In short: you may use, change and share the code; you may not resell it as a service.
Jarvis is source-available software licensed under the Jarvis Source Available License 2.0. The licence permits you to use, copy, modify and distribute the software. It does not permit you to make Jarvis, or a modified version of it, available to third parties as a hosted service or a product whose value is substantially Jarvis itself.
You must retain copyright and licence notices, include the licence with any copies you distribute, and mark modified versions as modified.
The licence governs the software. These terms govern the hosted service and this website. Where the two conflict regarding the software itself, the licence prevails. The licence contains its own governing law provision, which applies to the software independently of section 18.
6. Accounts
In short: keep your login secure; what happens under it is your responsibility.
Hosted plans require an account. Accounts are provided through Clerk. You are responsible for keeping your credentials confidential and for all activity under your account. Because Jarvis acts on your machines and in your connected services, this matters more than it would for an ordinary service. Notify us promptly at team@usejarvis.dev if you believe your account has been compromised.
You may close your account at any time. Closing it ends your subscription, and section 10 applies.
7. Hosted plans
In short: a plan is one brain for one person, on as many of your own machines as you like.
A paid plan provides one hosted Jarvis brain for one account. An account may hold one hosted instance.
Plans are not priced per machine. You may connect any number of computers you control to your brain. Each runs the Jarvis app and is enrolled with its own key. There is no device limit and no per-device charge.
A plan is for one person. Sharing an account so that more than one person uses a single brain is not permitted. Each person requires their own subscription. For teams, contact us.
Every enrolled machine has access to the same brain, and an action Jarvis takes may run on any enrolled machine. Enrol only machines you control, and remove machines from your account when you no longer control them.
We offer three plans: Jarvis at $29.99 per month, Jarvis Pro at $99.99 per month, and Jarvis Max at $199.99 per month. Plans differ in compute, storage, included AI usage, realtime voice, retained history and support response. What each plan includes is described on the pricing page and shown in the plan picker before you pay. The plan picker is the offer: it displays the current allowances of the plan and any add-ons you select, and is the final description before payment.
We may change what a plan includes. If a change materially reduces a plan you subscribe to, we will notify you before it takes effect and you may cancel.
8. Included AI usage
In short: AI is included up to your plan's allowance, then stops until the next period. There is no overage billing.
On a hosted plan, AI usage is included and routed through our service. You do not need to configure provider keys. The models available to you depend on your plan.
Included usage is allocated per billing period and stops when exhausted. When you reach your allowance, AI requests return an error stating that the allowance is exhausted, and resume when the period resets. Usage does not silently continue on a different model, and unused allowance does not carry over.
There is no overage billing. You will not be charged beyond your plan price for AI usage. To increase your allowance, upgrade your plan or purchase an add-on.
You may add your own AI provider key on a hosted plan. Usage through your own key is billed to you directly by that provider and is outside your included allowance.
9. Fees and billing
In short: plans renew automatically, Stripe handles payment, you can cancel any time, and started periods are not refunded except where the law requires.
Renewal and price
Plans are subscriptions that renew automatically at the end of each billing period until cancelled. You will be charged the price and currency shown at checkout, plus applicable taxes, which are calculated by Stripe from your location and shown before you pay.
Stripe processes payments. Your card details are provided to Stripe and are not stored by us. Stripe's terms apply to you as a payer.
If we change the price of a plan you subscribe to, we will notify you before the change takes effect and you may cancel before being charged the new price. Plan changes mid-period are prorated.
Cancellation
You may cancel at any time from your account page. Manage in Stripe opens the Stripe billing portal, where you can choose to end the subscription immediately or at the end of the current period. When the subscription ends, section 10 applies.
Failed payments
If a payment fails, your subscription enters a past-due state, we notify you by email, and Stripe retries the payment over its retry period. Your instance continues to run during that period. If payment is not collected, the subscription is cancelled and section 10 applies.
Refunds
Fees for a billing period that has begun are non-refundable, except where required by law. Cancelling stops future charges. If the Service was unavailable or you were charged in error, contact us at team@usejarvis.dev.
Nothing in this section limits any right to cancel or receive a refund that you have under the consumer protection law of the place where you live.
10. When your subscription ends
In short: your instance stops, your data is held for thirty days, then it is permanently deleted.
When your subscription ends, for any reason:
- Your instance is suspended. The brain stops running, your enrolled machines can no longer reach it, and scheduled work stops.
- Your data is retained for 30 days. Everything held by your instance remains stored for 30 days. If you subscribe again within that period, the same instance is restarted with its data intact.
- Your data is then permanently deleted. After 30 days, the instance and all data it held are deleted and cannot be recovered. We send a reminder by email before the period ends.
To obtain a copy of your data before deletion, contact us while your instance still exists and we will provide an export. Billing records are retained as required by law, as described in the privacy policy.
11. Acceptable use
In short: do not resell it, break the law with it, use it on machines or accounts you do not own, or attack the platform.
You agree not to:
- Resell the Service. Make Jarvis, or a modified version of it, available to third parties as a product or service whose value is substantially Jarvis itself, whether self-hosted or through a hosted plan.
- Use the Service unlawfully. Including unauthorised access to systems, fraud, spam, harassment, stalking, distributing malware, scraping in breach of third-party terms, or directing Jarvis to do any of these.
- Operate on machines or accounts you are not entitled to. Enrolling a machine you do not control, or using Jarvis to operate a third-party service in breach of that service's terms, requires the permission of the owner.
- Interfere with the platform. Including other customers' instances, the control plane, the AI service, rate limits or billing. Reporting a vulnerability to us is welcome; exploiting one is not.
- Share or transfer your account, as described in section 7.
12. Suspension and termination
In short: we can suspend or close an account for breach, non-payment or legal reasons, with notice where we can give it.
We may suspend or terminate your account for a breach of these terms, for non-payment, or where required by law. Where practicable, we will give you notice and an opportunity to remedy the issue. Where there is ongoing harm, a legal requirement or a compromised account, we may act first and notify you afterwards.
Termination follows the same process as cancellation: your instance is suspended and the 30-day retention period in section 10 applies before deletion.
13. Jarvis acts on your behalf
In short: Jarvis takes real actions on your machines and in your accounts. You decide how much freedom it has, and the results are yours.
Jarvis is an agent, not only a chat interface. It can operate your browser within your logged-in sessions, control desktop applications, run commands as you, read and write your files, observe your screen, and perform some of these actions on a schedule while you are away. The disclaimer describes these capabilities and the authority levels that govern them. By using Jarvis, you accept the following:
- You control the authority level. Ten authority levels govern what Jarvis may do without asking you first. Raising the level is your decision, and you are responsible for actions taken within the authority you grant.
- You are responsible for actions taken under your accounts. To every third-party service, Jarvis acting under your login is you. We cannot see which accounts you connect and cannot supervise them.
- You are responsible for third-party data. If you direct Jarvis to an inbox, a CRM or a shared drive, you are processing information about other people, and you are responsible for doing so lawfully.
- Output is not professional advice. Jarvis may draft contracts, invoices, financial or legal content because you ask it to. None of it is reviewed by a professional. Obtain professional advice before relying on it.
Jarvis can make mistakes. Its decisions are produced by AI models, which can misinterpret instructions and generate incorrect information with apparent confidence. Because Jarvis acts rather than only answers, a mistake can result in a real action in a real account. Review what Jarvis proposes to do, and do not direct it at irreversible actions you are not prepared to accept.
14. Beta software
In short: Jarvis is pre-1.0 software and changes quickly.
Jarvis is beta software at a 0.x version. Features, configuration and behaviour may change between releases, and releases may contain defects. Do not rely on Jarvis for critical or irreversible work without supervision.
15. Disclaimer of warranties
In short: the Service is provided as is, without guarantees, and there is no service level agreement.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE, UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT JARVIS WILL PERFORM ANY ACTION IN THE MANNER YOU INTENDED.
There is no service level agreement on any plan. Support response times shown on the pricing page are targets, not guarantees, and no service credits apply.
16. Limitation of liability
In short: we are not liable for indirect losses, and our total liability is capped at what you paid us in the previous twelve months.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR BUSINESS, OR FOR THIRD-PARTY OR AI PROVIDER COSTS YOU INCUR, OR FOR ACTIONS TAKEN IN YOUR ACCOUNTS BY JARVIS ACTING WITHIN THE AUTHORITY YOU GRANTED, ARISING FROM OR RELATED TO THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. FOR SELF-HOSTED USE, THAT AMOUNT IS ZERO.
Some jurisdictions do not allow certain exclusions or limitations of liability, and consumer protection law where you live may give you rights that cannot be limited by agreement. Nothing in these terms limits those rights. Where a limitation above is unenforceable against you, it does not apply to you, and the remainder of these terms continues in effect.
17. Indemnity
In short: if your misuse of the Service causes a claim against us, you cover it.
You agree to indemnify us against claims, damages and reasonable costs arising from your breach of these terms, your unlawful use of the Service, or actions you direct Jarvis to take in third-party accounts or on third-party data.
18. Governing law and disputes
In short: Delaware law, Delaware courts, and your local consumer rights are unaffected.
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising from these terms or the Service will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction.
If you are a consumer in the UK or the EU, this section does not deprive you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings there.
The software licence contains its own governing law and venue provisions, which apply to the software independently of this section.
19. Changes to these terms
In short: we may update these terms; material changes to paid plans come with notice; section 4 cannot be removed retroactively.
We may update these terms. When we do, the date at the top of this page changes. For changes that materially affect a paid plan, we will notify you by email before they take effect. If you do not accept a change, you may cancel, and section 10 applies. Continued use after a change takes effect constitutes acceptance.
Section 4 is protected. A future version of these terms that removes the free self-hosting commitment does not apply to any release published while section 4 was in effect.
20. General
In short: the usual provisions on severability, assignment and the complete agreement.
If any provision of these terms is found unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These terms, together with the privacy policy, the disclaimer and the software licence, are the entire agreement between you and us regarding the Service.
